These Terms & Conditions (“Terms”) govern your access to and use of the Dataforensics website, software platform, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Dataforensics provides a cloud-based field data collection, management, and reporting platform designed for engineering consultants, government agencies, contractors, and infrastructure project teams.

We reserve the right to modify, update, or discontinue any aspect of the Services at our discretion.

3. Account Registration & Responsibilities

To access certain features, users may be required to create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of login credentials
  • Notify us promptly of unauthorized account use
  • Use the Services in compliance with applicable laws

You are responsible for all activities conducted under your account.

4. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Upload or transmit malicious code or harmful content
  • Attempt unauthorized access to systems or data
  • Interfere with platform functionality or security
  • Reverse engineer, copy, or replicate the software

Violation of these terms may result in suspension or termination of access.

5. Intellectual Property

All intellectual property rights related to the Dataforensics platform, website, and associated materials remain the exclusive property of Dataforensics or its licensors.

Except as expressly permitted, you may not:

  • Copy, reproduce, distribute, or modify the platform
  • Use branding, trademarks, or logos without permission

Clients retain ownership of their project data entered into the platform.

6. Client Data

You retain ownership of all data submitted to the platform (“Client Data”).

By using the Services, you grant Dataforensics a limited license to host, process, and transmit Client Data solely for the purpose of providing the Services.

You are responsible for ensuring that you have the right to upload and process all Client Data within the platform.

7. Data Security

Dataforensics implements reasonable administrative, technical, and organizational safeguards to protect Client Data.

However, no system is completely secure, and we do not guarantee absolute protection against unauthorized access.

8. Fees & Payment (If Applicable)

If Services are provided under a paid subscription or agreement:

  • Fees will be outlined in a separate order form or agreement
  • Payment terms will be specified in the applicable contract
  • Failure to make timely payments may result in suspension of Services

Government or enterprise agreements may be governed by separate contractual terms.

9. Termination

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, Dataforensics disclaims all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee uninterrupted or error-free service.

11. Limitation of Liability

To the fullest extent permitted by law, Dataforensics shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Data loss resulting from user actions or third-party events

Total liability shall not exceed the amount paid by the client for Services in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Dataforensics from any claims, damages, or liabilities arising from:

  • Your use of the Services
  • Violation of these Terms
  • Infringement of third-party rights

13. Third-Party Services

The Services may rely on third-party infrastructure providers (e.g., hosting services). We are not responsible for disruptions caused by third-party providers beyond our reasonable control.

14. Governing Law

These Terms shall be governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the courts located in Georgia, unless otherwise agreed in a separate written agreement.

15. Changes to Terms

We may update these Terms periodically. Updated versions will be posted on this page with a revised “Last Updated” date.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
